TERMS & CONDITIONS OF YOUR STAY

  1. DEFINITIONS

1.1. “Activities” means the activities listed at clause 5.3

1.2. “Camp” means the cleared area marked on the Mud Map

1.3. “Check-In Time” means 3pm

1.4. “Check-Out Time” means 10am

1.5. “You” means the individual named on the online booking and all Guests

1.6. “Company” means Fredericks Corporation Pty Ltd ACN 123 658 980, its staff, directors, officers, employees, agents and/or subcontractors

1.7. “Guests” means any individual staying at the Camp through/under your booking

1.8. “Mud Map” means the map attached to the back of these Terms

1.9. “Terms” means these terms and conditions of your stay

  1. PAYMENT TERMS

2.1 Deposit amount payment is required at time of booking

2.2 Confirmation of booking payment equivalent to the balance of 50% of the booking is due six months prior to arrival

2.3 Final & full payment as per invoice is due and payable prior to arrival

2.4. Payments are not refunded in the event of a client cancellation, rescheduling is considered a client cancellation.

2.5. If local, state or federal government enacts policy preventing access to the property or our providing services to the client we will reach out to reschedule. This is only effective if government direction is in force at the time of booked check in. Examples are (but not limited to) COVID policy restrictions and Bush Fire Warnings / Advice.

2.6. All prices are inclusive of GST (Goods and Services Tax)

  1. ACCOMMODATION AND BUILDINGS

3.1. The Company provides rustic dormitory style accommodation, you acknowledge that you are aware of the accommodation offering and style. 

3.2. Linen is booked separately, should you have not booked linen packs you are required to bring your own linen, including pillows, sheets, blankets, towels, tea towels, etc.

3.3. The Company provides the following accommodation options:

3.3.1. Jarrah Bunkhouse

Sleeps up to 30 people, upstairs 20 bed dormitory, Downstairs includes: small private room with ensuite, common area with optional extra bunk space for 8, bathroom with two toilets and two showers, a kitchen area, fridge, freezer, microwave, basic pots/pans, crockery, cutlery, access to camp BBQ facilities.

3.3.2. Marri Bunkhouse

Sleeps up to 30 people, upstairs 20 bed dormitory, Downstairs includes: small private room with ensuite, common area with optional extra bunk space for 8, bathroom with two toilets and two showers, a kitchen area, fridge, freezer, microwave, basic pots/pans, crockery, cutlery, access to camp BBQ facilities.

3.3.3. Wattle Chalet

Sleeps up to 10 people and includes two toilets, one shower, a kitchen area, fridge, freezer, microwave, basic pots/pans, crockery, cutlery, access to camp ablution block and access to camp BBQ facilities.

3.3.4. Snottygobble Cubby

Sleeps up to 10 people, includes access to camp ablution block and camp BBQ facilities. No kitchen facilities provided.

3.3.5. Sheoak Bunkhouse

Sleeps up to 72 people in 4 dormitory quarters. Each quarter includes a 12-berth bunkroom, small private room with ensuite, small 4-5 bed dormitory, bathroom with 2 toilets and 2 showers and a communal kitchen area, fridge, freezer, microwave, basic pots/pans, crockery, cutlery, access to camp BBQ facilities.

3.3.6. Dining Hall

A 10m by 10m fully enclosed space. 

3.3.7. Function Centre

A 300m2 function space with small kitchenette, male and female toilets. This building includes furniture if it is required to be removed and stored then a fee will apply.

3.3.8. Camping area

Camping area is approximately 15 acres  and is available by request on a leave no trace basis.

3.3.9. The Main House 

The main house sleeps 10 people – one king ensuite room, one twin room and three queen rooms alongside two living areas, kitchen area, fridge, freezer, microwave, basic pots/pans, crockery, cutlery. The pool and Jarrahfall goats and chickens are just outside too. Linen is included in this hire.

  1. CATERING

4.1. Upon your request, the Company may provide catering options, including continental breakfast, cooked breakfast, lunch and dinner options. The catering costs will vary based on the number of people, the nature of the request and may be affected by specific dietary requirements.

  1. FACILITIES AND ACTIVITIES

5.1. There are bike tracks and bushwalking trails which extend outside of the Camp. You access these tracks and trails completely at your own risk. The Company does not routinely maintain these tracks and bears no responsibility for their upkeep/condition.

5.2. Upon your request, the Company may arrange additional activities including:

5.2.1. Splatball

You (and children under your care) must be 8 years or older to participate. Costs include use of all of the Company gear, including goggles, masks, splatball guns etc. Please note participants to bring suitable clothing to participate no overalls are supplied. 

5.2.2. Abseiling & Rock Climbing

Cost includes an instructor, safety equipment and tower hire. Sessions last 3 hours or can be booked for the entire day, but each session is limited to 18 people. Max abseil weight is 120kg. max climber weight is 120kg.

5.2.3. Kayaking

Cost includes an instructor, safety equipment, bus transportation and entry to Lane Pool Reserve. Sessions last 3 hours or can be booked for the entire day, but each session is limited to 18 people. Max paddler weight is 100kg, must fit our largest life jacket

5.2.4. Archery Tag, Bushtrails & Cuby Building, Forest Ecology and Regeneration, Commando Course, Team Building Games, Orienteering, Raft Building, Mountain Biking and / or Flying Fox

Cost includes an instructor (if applicable), equipment (if applicable) and transportation (if applicable). Sessions last 3 hours, but each session is limited to 18 people. Max Flying Fox rider weight is 120Kg.

5.3. It is your responsibility to notify the Company in writing if you or any other guest are unable to participate in any of the Activities due to personal health or safety reasons.

5.4. Each guest participating in the Activities must sign a waiver & acceptance of risk prior to any equipment being made available.

5.5. You agree that no Activities are to be undertaken within 8 hours of alcohol intake or with a blood alcohol concentration exceeding .05 % and you consent to submitting to a breath test on request.

5.6. The Company reserves the right to withdraw equipment or access to any Activities should you be found abusing Activity equipment, be found intoxicated or be found acting in an irresponsible manner.

5.7. While the Company takes responsibility for the technical skills & technical safety aspects of an Activity, specifically instruction, demonstration and personal protective equipment assistance, it is ultimately your choice to decide whether or not to proceed with any or all of the Activities. You acknowledge that there is an inherent risk involved in the Activities and that the Company will under no circumstance be held responsible or liable for any injury or loss sustained or resulting from participation in Activities.

5.8. With the exception of push bikes, the use of private or personal recreational sport or fitness equipment (or the like), and or the bringing onto the Camp of the same is not permitted without the previous written permission of the Company. The Company reserves the right to refuse the use of, or to confiscate any equipment it considers to be breaking this condition.

  1. ARRIVALS

6.1. You are responsible for ensuring all guests are aware of the bookings rules and terms and conditions. You accept liability for any damage caused by your guests.

6.2. You acknowledge that if you arrive earlier than the Check-In Time, you may be denied access to the Camp up to the Check-In time.

6.3. You agree not to drive any vehicle through the camp faster than 10km/h. Drivers reported or seen driving unsafely through the Camp, will be asked to leave the Camp immediately and will forfeit any money paid.

6.4. You will park strictly in the designated parking areas and otherwise in accordance with the instructions of the Company and its staff.

  1. OBLIGATIONS DURING OCCUPANCY

7.1. You agree to notify the Company (or its staff) of any damage caused to the Camp as soon as reasonably practicable and except for reasonable wear and tear, reimburse the Company for such damage.

7.2. You agree to clean the camp BBQ facilities after use.

7.3. You acknowledge that there may be other groups/campers onsite and agree to reduce noise (specifically after 10pm) to ensure the quiet and peaceful enjoyment of all groups/campers in the Camp.

7.4. You acknowledge that the Camp includes a dam and a confidence course which can both pose significant hazards that can result in death. Any use of these areas is completely at your own risk.

7.6. You agree to ensure that any children are supervised at all times.

7.7. You are only permitted to access the buildings/areas allocated to you (or allocated as common property).

  1. CAMPFIRES

8.1. You acknowledge that campfires are strictly prohibited between 1 December and 31 March, along with days of high fire danger. These dates may be changed or extended by the shire it is the hirers responsibility to check with management. 

8.2. You agree to only light campfires (outside of the dates noted in clause 8.1. ) in the designated campfire pits.

8.3. You acknowledge that no firewood is provided for campfires.

8.4 Special permission for campfires in the camping area may be granted subject too all fires being in raised fire pits and all remanence of the fires being removed prior to checkout. Please ensure you seek management approval prior to your stay. 

  1. GROUNDS

9.1 Set up of any equipment, marquees, temporary shelters or other structures on the site is subject to the following conditions;

9.1.1. Pegs, posts, stakes or any other ground penetration must only be used with prior approval and not within 20 metres of existing buildings or structures.

9.1.2. You acknowledge that any damage to underground services or reticulation will be charged back to the hirer. This may include costs for replacement of lost water.

9.2 Access to the general grounds and in particular grassed surfaces are subject to the following conditions;

9.2.1 No vehicles on the oval, grassed areas or non-roadway surfaces at any time without express prior consent from management.

9.2.2 No vehicle movement on the grassed areas during heavy rainfall, when they are sodden or if there is standing water. All damage caused to grassed areas during hire will be repaired at the cost of the hirer.

9.2.3 Matting must be used on grassed areas where any high foot traffic occurs to protect the grass. This includes areas where there may be lines of people or frequent gatherings. 

9.2.4 Any damage to the grounds will be charged to hirer. 

  1. DEPARTURES AND MAKE-GOOD

9.1. You will depart the Camp no later than the Check-Out Time on the day of departure, unless otherwise agreed with the Company. If check out of buildings and / or departure time from the property is required any later than 11am or 2pm respectively, the customer must book that evening to secure use of the property.

9.2. Prior to departure you will:

9.2.1. ensure all furniture is left in the location and state it was found in;

9.2.2. ensure all lights, taps and power-points are turned off;

9.2.3. ensure that any designated fire pits used during your stay are completely extinguished;

9.2.4. each building will be thoroughly clean upon your arrival. Buildings should be left as found.

9.2.5. clean kitchen, stove, fridges and bathroom (if applicable); and sweep, vacuum and mop all floors.

9.2.6. Property damage will be charged to the hirer. 

  1. SMOKING

10.1 All buildings are strictly non-smoking. Smoking inside a building automatically incurs a $500 additional cleaning charge

  1. SOCIAL MEDIA

11.1 There are to be strictly no inappropriate or explicit images on social media when checking in or tagging the venue. 

  1. DRUGS & ALCOHOL

12.1. The Camp is not a licensed venue and does not supply, sell or disburse alcoholic beverages.

12.2. You acknowledge that any alcohol consumed in the Camp carries potential risks and dangers beyond the control of the Company.

12.3. You assume all responsibility for any negligence which arises from or is contributed to by the consumption of alcohol.

12.4. You agree to indemnify, defend, release and hold harmless the Company for any and all claims, demands, losses or damages, suits, fines, including court costs and professional fees, for any injury or death arising out of the consumption of alcohol at the Camp.

12.5. Illegal drugs are prohibited in the Camp. If the Company becomes aware that you possess any illegal substances, you will be asked to leave and any money that you have paid will be forfeited.

12.6. No glass containers / bottles are to be used outside of the kitchen area.

  1. ACKNOWLEDGMENT OF RISK

13.1. You acknowledge the inherent risk (which could result in permanent or temporary injury and death) of all activities and bush camping, including but not limited to falling limbs from trees, holes and ruts in grounds, insects, snakes and spiders and will take necessary and reasonable precautions against same.

13.2. The Company takes no responsibility for loss or damage to personal property.

  1. LIMITATION OF LIABILITY

14.1. To the fullest extent permitted by law, the Company is not liable for any loss or damage, however caused (including, but not limited to, by the negligence of the Company), suffered by you or any other person in connection with:

14.1.1. inclement weather and any consequential damage (to person or property) caused by such weather;

14.1.2. falling limbs from trees;

14.1.3. injury from animal or insect;

14.1.4. injury from any activity listed in clause 5.3. ;

14.1.5. any misrepresentation by the Company;

14.1.6. any statement by a third party accepted in good faith by the Company and repeated by it, in connection with the Camp or any of the Activities; or

14.1.7. the Camp generally.

14.2. Nothing herein excludes, restricts or modifies any condition, warranty, right or remedy, implied or imposed by any statute or regulation that cannot lawfully be excluded, restricted or modified. However, all express or implied representations, conditions, warranties and provisions, whether based in statute, common law or otherwise, relating to the provision of services as contemplated by these Terms that are not contained in these Terms, are excluded to the full extent permitted by law.

  1. GOVERNING LAW AND JURISDICTION

15.1. These Terms shall be governed by and construed in accordance with the Laws of Western Australia.

15.2. You and the Company each irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of Western Australia whether State or Federal and each waives any immunity or any objection it may have to any action in those Courts and to a claim that any action has been brought in an inconvenient forum or to those Courts not having jurisdiction.

  1. PETS

16.1 Pets are not allowed onsite without express prior consent of the business owner.
